# Bildnachweis / Image licence record

Source images for the GEAK Bern lead-generation site. Every file here was sourced
under a licence that permits **commercial use**, and each licence was verified
per file — not inferred from the hosting site.

Checked and recorded: 1 October 2026.

## Rules this set was vetted against

- Commercial use permitted. No licence in this set forbids commercial or
  advertising use.
- No CC-BY-SA or other share-alike terms, and no copyleft licence that would
propagate to the site's own work.
- No paid stock. No commissioned photography.
- Attribution lines are given verbatim for every file whose licence requires
one. Two of the seven require attribution (marked **yes** below); the other
five do not, and three of those are credited voluntarily.

## Rejected during vetting, and why

These are recorded because they are the sources most likely to be proposed
again, and in each case the licence — not the image — is the blocker.

- **NREL / NLR Image Gallery** (30,000+ renewable and efficiency photos).
Rejected. Operated by Alliance for Energy Innovation under an End-User
Content License Agreement that is **revocable at will without notice**
(clause 1g), requires attribution to NLR/DOE **and the original creator** on
every use (clause 1d), and **forbids uploading the content into any AI
program, machine learning model or LLM without prior written consent**
(clause 1e). A revocable licence is not a foundation for a commercial site.
  <https://www.nlr.gov/news/image-gallery-user-agreement>
- **NREL / DOE federal works in general.** US federal works are public domain
in the US under 17 U.S.C. §105, but that rule **has no effect abroad**, so
these images remain protected in Switzerland. Never rely on §105 for a
  Swiss-hosted commercial site.
  <https://en.wikipedia.org/wiki/Copyright_status_of_works_by_the_federal_government_of_the_United_States>
- **Building Performance Institute (BPI).** No free photo library exists. The
BPI store photo gallery is empty merchandise, and the similarly named
`bpiphotography.net` is an unrelated New Jersey senior-portrait business
  (Bowen Photography). Nothing to vet.
- **Building America Solution Center (DOE).** Its own content-submission terms
require the submitter to own the copyright in every submitted photo, so the
gallery has mixed provenance and no blanket clearance; it is also
Battelle/PNNL contractor work rather than federal employee work.
  <https://basc.pnnl.gov/criteria-submitting-content-building-america-solution-center>
- **Wikimedia Commons share-alike files.** Of 402 files inspected across
  Category:Heat pumps, Category:Boilers, Category:Heat exchangers,
  Category:Refrigeration, Category:Cooling towers, Category:Chillers and
related categories, **288 were CC-BY-SA** and were rejected outright.
- **Free Art Licence (FAL 1.3) on Commons.** Looks permissive, but it is
copyleft — the licence requires FAL to be applied to any work derived from
it. Same disqualifier as CC-BY-SA, so it was rejected too.
  <https://commons.wikimedia.org/wiki/Commons:Free_Art_License_1.3>
- **Unsplash+ results.** Several of the top Unsplash hits for "heat pump" and
"heating pipes" are `plus.unsplash.com/premium_photo-` — the paid tier. All
were excluded; only free-tier images appear below.
- **Specific images rejected on inspection, not licence:** the WZW Zürich
waste-heat plant series (CC0) is exterior smokestacks and smog; a Czech
"Demo Predavaci Stanice Tepla" (CC0) is an outdoor trade-fair display on a
lawn with a vendor banner and bystanders; a Pexels plant-room candidate
carried a visible **Biral** logo and a **Wilo** pump; an Unsplash candidate
carried the same kind of visible branding.

### Sources and licences in full

**1. `hero-technikraum.jpg` — the homepage hero**
- Source: <https://unsplash.com/photos/a-bunch-of-pipes-that-are-inside-of-a-building-8Q_5QjmBXus>
- Author: `@steffen_l` on Unsplash
- Licence: Unsplash License — <https://unsplash.com/license>
- Attribution required: **no.** "Commercial and non-commercial purposes, no
permission needed (though attribution is appreciated!)"
- Processing applied: native master is 5291×7933 (portrait 2:3). Cropped to a
5291×2976 band at y=1240 for the 16:9 frame, then downscaled to 2560×1440.
No upscaling at any sane desktop width.
- Note: a red hose, two unlabelled valves and a cabinet edge appear at the
far left. Zoomed and checked — **no brand, logo or label is legible**, and at
display size it reads as texture.

**2. `heizraum-verteilung.jpg`**
- Source: <https://commons.wikimedia.org/wiki/File:Fernw%C3%A4rmestation_Verteilung.jpg>
- Author: Pedalito. Description: *Fernwärmeverteilung, an der Fernwärmeübergabestation.*
- Licence: CC0 1.0 Universal Public Domain Dedication —
  <https://creativecommons.org/publicdomain/zero/1.0/>
- Attribution required: **no.**
- Processing applied: the original carries a red **MAGIRA** manufacturer logo at
28.0–46.9% of frame width. A left-hand crop removing 47% of the frame
(cropping at x=1488 of 3147) removes the logo completely; the result is
1659×2360, portrait. **A 20% crop does not remove the logo** — the measured
right edge of the lettering sits at 46.9% of frame width.
- Trade-off of that crop: it discards the left half of the scene, including the
blue actuator boxes, green circulator pump and manifold assembly. What
remains is closer to the hero's subject matter, which is why this file is the
portrait option and not the hero.

**3. `kessel-technikraum.jpg`** — attribution required
- Source: <https://commons.wikimedia.org/wiki/File:BoilerWithPipes.jpg>
- Author: Kimmo Palosaari, Pietarsaari, Finland
- Licence: Creative Commons Attribution 2.0 — <https://creativecommons.org/licenses/by/2.0>
- Attribution required: **yes.**
- Credit line to publish: `Foto: Kimmo Palosaari, CC BY 2.0, via Wikimedia Commons`
- Verified: real industrial boiler room, no people, no logo, no legible nameplate.

**4. `waermetauscher.jpg`**
- Source: <https://commons.wikimedia.org/wiki/File:Fernw%C3%A4rme%C3%BCbergabestation_W%C3%A4rmetauscher.jpg>
- Author: Pedalito. Description: *Wärmetauscher einer Fernwärmeübergabestation.*
- Licence: CC0 1.0 — <https://creativecommons.org/publicdomain/zero/1.0/>
- Attribution required: **no.**
- Verified logo-free at zoom. An apparent "MAHEMA" mark is a reflection on a
  metal cover, not a logo.

**5. `fernwaerme-uebergabestation.jpg`**
- Source: <https://commons.wikimedia.org/wiki/File:Fernw%C3%A4rme%C3%BCbergabestation.jpg>
- Author: Pedalito. Description: *Fernwärmeübergabestation für 260 kW.*
- Licence: CC0 1.0 — <https://creativecommons.org/publicdomain/zero/1.0/>
- Attribution required: **no.**
- Verified: full grid sweep plus mid-frame zoom. No manufacturer logo, no
brand name, no painted lettering, no people.

**6. `heizraum-krankenhaus.jpg`**
- Source: <https://commons.wikimedia.org/wiki/File:KH_St_Elisabeth_2013_Technik_16.jpg>
- Author: Andreas Praefcke. Description: *Ravensburg, Krankenhaus St. Elisabeth,
Technikzentrale im Untergeschoss des neuen Bettenhauses … Wärmepumpe.*
- Licence: Public domain (own work, released) — <https://commons.wikimedia.org/wiki/Commons:Reusing_content_outside_Wikimedia>
- Attribution required: **no.** Crediting the author is voluntary and costs
nothing, so it is listed anyway.

**7. `heizung-grundriss.png`** — attribution required
- Source: <https://commons.wikimedia.org/wiki/File:Plochingen-_2.Nebengeb%C3%A4ude_Wohngeb%C3%A4ude_Heizung_(Grundri%C3%9F_Erdgescho%C3%9F)_-_LABW_-_Staatsarchiv_Ludwigsburg_K_412_IV_DO_8800.jpeg>
- Author/licensor: **Staatsarchiv Ludwigsburg** (Landesarchiv
  Baden-Württemberg), catalogue reference K 412 IV DO 8800
- Licence: Creative Commons Attribution 4.0 — <https://creativecommons.org/licenses/by/4.0>
- Attribution required: **yes.**
- Credit line to publish: `Plan: Staatsarchiv Ludwigsburg, CC BY 4.0, via Wikimedia Commons`
- Note: the licensor here is the **archive**, not a photographer. A credit
reading only "Wikimedia Commons" would be technically incomplete.
- Use: low-opacity background texture behind the process section. Not a hero.

## Where attribution is discharged

Both required credit lines are rendered in **two** places, from one shared data
source, so the two cannot drift apart:

- **`src/lib/image-credits.ts`** — the single source of truth. Each entry
carries the author, the exact licence name, the licence deed URL, the source
URL, the intermediary it is credited through, and whether attribution is
  mandatory.
- **The site footer** (`src/components/Footer.tsx`) — a "Bildnachweise" block
  above the copyright line.
- **The Impressum** (`src/app/(site)/impressum/page.tsx`) — a
"Verwendete Fremdbilder" section listing all four images, marking which two
require attribution and which two are voluntary.

**Coverage.** `Footer` is rendered by `src/app/(site)/layout.tsx`, which wraps
every page in the `(site) route group, and by `src/app/not-found.tsx`. Every
image in this set is destined for pages inside that group, so the footer block
appears on every page where an image can appear. Verified in the built HTML:
both blocks render, and all four credit lines plus all four licence deed links
are present in `/impressum`.

The Impressum's "Urheberrecht" paragraph was also **narrowed** — it previously
claimed that all content on the site was protected and that reuse required
written consent, which would have been a false statement on a page carrying
CC BY images. It now explicitly covers the texts and in-house content only.

The two entries requiring attribution:

- `Foto/Plan: Kimmo Palosaari, CC BY 2.0, via Wikimedia Commons`
  + <https://creativecommons.org/licenses/by/2.0>
- `Plan: Staatsarchiv Ludwigsburg, CC BY 4.0, via Wikimedia Commons`
  + <https://creativecommons.org/licenses/by/4.0>

Note the archive is the licensor on the Plochingen plan, so a credit reading
only "Wikimedia Commons" would be technically incomplete.

## Layout constraint — hero type placement

**The hero type goes in the left or right third. It does not go bottom-centre.**

Measured on the 5291×2976 hero frame:

| Region | Mean luminance | Std dev | Reading |
|---|---|---|---|
| left 22% strip | 106.0 | 49.2 | calm concrete, usable |
| right 22% strip | 117.4 | 49.9 | calm concrete, usable |
| centre 56% | 107.6 | 71.4 | busiest — risers, elbows, brackets |

The lower centre of the frame is where the vertical risers and the elbow
bends are densest, so centred type there lands on high-contrast metalwork and
loses legibility. The left and right edges are the only regions with enough
consistent tone to carry overlaid text.

Note the earlier misconception this replaces: the dark foreground band with
room for type exists only in the *bottom* crop band of the source photo, and
that band is cluttered with a hi-vis vest and cardboard boxes. The chosen band
has no dark foreground band at all.

## What is served, and from where

Optimised web derivatives are in `public/images/` and are what the site serves.
Full-resolution masters are retained for future re-cuts in `assets/masters/`,
which is **versioned but not served** — it is outside `public/`, so Next.js
never delivers it.

Served files, with the reference path a component should use:

| Reference path | Dimensions | Size | Role |
|---|---|---|---|
| `/images/hero-technikraum.jpg` | 1920×1080 | 442 KB | hero, primary |
| `/images/hero-technikraum-2560.jpg` | 2560×1440 | 965 KB | hero, retina `srcset` |
| `/images/hero-technikraum-1200.jpg` | 1200×675 | 149 KB | hero, mobile `srcset` |
| `/images/heizraum-verteilung.jpg` | 1400×1992 | 282 KB | commune/record, primary |
| `/images/heizraum-verteilung-900.jpg` | 900×1280 | 109 KB | commune/record, small |
| `/images/kessel-technikraum.jpg` | 1800×1350 | 421 KB | commune/record, primary |
| `/images/kessel-technikraum-1200.jpg` | 1200×900 | 196 KB | commune/record, small |
| `/images/waermetauscher.jpg` | 1400×1867 | 301 KB | commune/record, primary |
| `/images/waermetauscher-900.jpg` | 900×1200 | 125 KB | commune/record, small |
| `/images/fernwaerme-uebergabestation.jpg` | 1400×1867 | 319 KB | commune/record, primary |
| `/images/fernwaerme-uebergabestation-900.jpg` | 900×1200 | 151 KB | commune/record, small |
| `/images/heizraum-krankenhaus.jpg` | 1200×1839 | 271 KB | record pages, primary |
| `/images/heizraum-krankenhaus-800.jpg` | 800×1226 | 125 KB | record pages, small |
| `/images/heizung-grundriss.png` | 2000×1053 | 1261 KB | texture, low opacity |

Served total: **5.1 MB** across 14 files, down from 18.8 MB when the masters
sat in `public/`. Masters in `assets/masters/` total 18.8 MB and are not
served.

Naming follows the one pre-existing asset in this project
(`beitragsgesuch-reihenfolge.svg`, referenced as an absolute `/images/...` path
in a plain `<img>`). `next.config.ts` has no `images` configuration, so these
are not routed through `next/image`. The project has no existing `srcset`
convention; the `-2560` and `-1200` / `-900` variants are staged so one can be
added when the components are wired up.

## Still outstanding

- These files are **staged only**. No component references any of them yet, so
the credits currently appear on every page but are not yet attached to any
  rendered image.
- The credits block is in place in the footer and the Impressum, so the
attribution obligation is discharged as of this commit. It must not be
removed while any image in this set is in use.
- A failed retouch of the MAGIRA logo on the `heizraum-verteilung` source was
attempted and abandoned; the logo is removed by cropping instead. The
failed-attempt comparison is at `/tmp/r_best_attempt.png` and is kept for
review. No retouched file is staged.
